ORDINANCE NO. 13-00
AN ORDINANCE TO AMEND THE WEST LAFAYETTE CITY CODE ON
WASTEWATER TREATMENT
WHEREAS, in order to provide for the orderly growth of the
city and to provide for utilization of available capacity, both in collection
and treatment, as set forth by the 20 Year Facility Plan, it is desirable to
amend the city code to provide for sewer extensions under limited circumstances
outside the corporate limits;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF WEST LAFAYETTE that:
Section 1. West Lafayette City Code section 30.06.09 is
amended to read as follows:
Sec. 30.06.9. Extension outside city limits.
No person shall directly or indirectly make any connection
with or opening into any public sewer or appurtenance owned or operated by the
city's POTW for the purpose of serving an area outside the corporate boundaries
of the city, except:
30.06.9.1. Connection or service is under the terms of a
valid agreement or contract with the city and in force at the time this
ordinance becomes effective.
30.06.9.2. Service to Purdue University.
30.06.9.3. Service to the area served by the facilities
formerly a part of the West Lafayette Regional Sewer District.
30.06.9.4. Service to any area that is expected to become a
part of the corporate limits of the City of West Lafayette but is not currently
contiguous or cannot be immediately annexed under Indiana law, provided that the
Board of Works finds that: (a) such service would be in the best interests of
the wastewater treatment utility, (b) the development to be served would conform
to city standards and be consistent with city planning, and (c) that such area
should become a part of the corporate limits of the city in the future.
30.06.9.35. Service has been provided before the effective
date of this ordinance.
This ordinance shall be in full force and effect
from and after its passage and signing by the Mayor.
