AN
ORDINANCE TO VACATE UTILITY EASEMENT

WHEREAS,
Shari Malini DeSilva and Shirin Ramani DeSilva (called "owners")
are the petitioners for real estate described as Lot 33 in Ridge
Hollow Subdivision, Part 3, located at 225 Pawnee Drive, West
Lafayette, Indiana; and
WHEREAS,
the owners filed a petition to vacate a 5 foot wide utility easement
along the northern line of Lot 33, for the purpose of relieving
the current encroachment of the existing swimming pool; and
WHEREAS
the owners have obtained all necessary approvals and releases
from all the utility companies and have complied with provisions
of IND. CODE 36-7-3.
THEREFORE BE IT ORDAINED BY THE COMMON
COUNCIL OF THE CITY OF WEST LAFAYETTE, INDIANA THAT:
Section1.
The following described utility easement located on property owned by
Shari Malini DeSilva and Shirin Ramani DeSilva be, and it is hereby
vacated:
Five
feet (5') of even width off of the entire northern end of Lot
Thirty-three (33) in Ridge Hollow Subdivision, Part Three, Auditor's
Key Number 164-04600-0943.
Section 2. The
Ordinance shall be in full-force and effect from and after its
passage and signing by the Mayor.
