ORDINANCE NO. 27-99
AN ORDINANCE TO ANNEX CERTAIN LANDS INTO THE
CITY
OF WEST LAFAYETTE (CALVARY BAPTIST CHURCH)
WHEREAS, there is a certain tract of land located
immediately north of land within the City of West Lafayette, Indiana;
and
WHEREAS, the landowners of at least fifty-one
percent (51%) of the proposed annexation tract and at least seventy-five
percent (75%) of the total assessed value of the proposed annexation
tract have filed a petition and request the City of West Lafayette,
Indiana, to annex the tract pursuant to Ind. Code § 36-4-3-5;
and
WHEREAS, the tract is needed and can be used
by the city for its continued growth and development in the immediate
future; and
WHEREAS, the tract is located along Kalberer
Road and more than one eighth (1/8) of the external aggregate
boundary of the tract is continuous with land within the City
of West Lafayette and the land is more than one hundred and fifty
(150) feet in width as by law required; the City, at little or
no additional cost, can provide the tract with regular common
noncapital services and the tract is appropriate for adjacent
urban growth and it will be serviced by Capital Improvement Services
which are currently planned and programmed for this area.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON
COUNCIL OF THE CITY OF WEST LAFAYETTE that:
Section 1. That the following described real
estate be and the same is hereby annexed into and made a part
of the City of West Lafayette, Indiana
A part of the Northeast Quarter of Section
6, Township
23 North, Range 4 West Wabash Township, Tippecanoe
County, Indiana, described as follows: Commencing at the Southwestern
corner of the Northeast Quarter of said Section 6; thence
North 00E05'00" East, along the western line of the Northeast
Quarter of said Section Six, 383.02 feet to the centerline
of County Road 350 North; thence South 88E47'30" East,
along the centerline of County Road 350 North, 673.20 feet
to the point of beginning of this description; thence North
00E13' 30" West, 660.12 feet; thence South 88E47'30"
East, 660.12 feet; thence South 00E13'30" East, 660.12
feet to the centerline of County Road 350 North; thence North
88E47'30" West, along the centerline of County Road 350
North; 660.12 feet to the point of beginning, containing 10.00
acres, more or less
Section 2. The annexed real estate shall be a
part of Common Council District 5.
