WHEREAS, the land described herein is contiguous to the current boundary of the City of West Lafayette; and WHEREAS, the Common Council has received a petition pursuant to Ind. Code § 36-4-3-5.1 for the annexation of the land described herein from the owner of 100% of the total assessed value of the land described herein; and WHEREAS, the land can be used for future development within the City of West Lafayette within the reasonably near and foreseeable future; and WHEREAS, all of the requirements of statute for the annexation of such land have been met. THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF WEST LAFAYETTE, INDIANA, THAT: Section 1. The following described land be, and the same is, hereby annexed to and declared a part of the City of West Lafayette, Indiana: KEY NUMBERS: 134-05600-0061 134-05500-0013 A part of the east half of the northeast quarter of Section Six (6), Township Twenty-Three (23) North, Range Four (4) West, and part of the northwest quarter of Section Five (5), Township Twenty-Three (23) North, Range Four (4) West, all in Wabash Township, Tippecanoe County, Indiana, being part of the land owned by the Trustees of Purdue University, Deed Book 158 Page 412, recorded May 29, 1923, in the Tippecanoe County Recorder's Office, being depicted on a plat of survey by Vester & Associates, Inc., Job No. E-98188A, more completely described as follows, to wit: Beginning at the northwest corner of the east half of the northeast quarter of Section 6-23-4, being marked by a 3/4" rebar with an aluminum cap stamped "VESTER & ASSOC. INC"; thence along the north line of the east half of the northeast quarter of said Section 6, South 89º22'49" East, 1324.73 feet to the northeast corner thereof, being marked by a P.K. nail in a concrete post; thence along the north line of the northwest quarter of Section 5-23-4, South 89º19'41" East, 1775.24 feet to the City Limits of West Lafayette per Ordinance 3-91, Document No. 91-02333, recorded February 20, 1991 in said Recorder's Office; thence along said City Limits, South 00º28'38" East, 2224.58 feet to the City Limits of West Lafayette per Ordinance 12-89; thence along said City Limits for the following two (2) courses: (1) North 89º59'41" West, 3069.05 feet; (2) North 89º11'11" West, 29.02 feet to the west line of the east half of the northeast quarter of said Section 6; thence along said west line, North 00º30'49" West, 2259.05 feet to the point of beginning, containing 159.5113 acres. SUBJECT TO ALL EASEMENTS, RESTRICTIONS, AND RIGHTS-OF-WAY OF RECORD. Section 2. Be it further ordained that the boundaries of the City of West Lafayette shall be, and same are, declared to extend so as to include all of the land described above as part of the City of West Lafayette, Indiana. Section 3. The land annexed by this ordinance shall be included in Council District 5. Section 4. This ordinance shall be in full force and effect from and after its passage and signing by the Mayor and notice, as provided by law.
