RESOLUTION NO. 19-97 (Amended)
A RESOLUTION FIXING FINANCIAL RESPONSIBILITY FOR STREET LIGHTS
AND FIRE HYDRANTS IN PLANNED DEVELOPMENTS WITHIN THE CITY OF WEST
LAFAYETTE, INDIANA

WHEREAS, the City of West Lafayette recognizes the value of planned
developments as described in the Unified Zoning Ordinance and
the pending New Unified Zoning Ordinance; and
WHEREAS, the City of West Lafayette wishes to establish guidelines
for financial responsibility for the street lights and fire hydrants
in said Residential Planned Developments (PD-R);
BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF WEST LAFAYETTE
that:
Section 1. Developers of Residential Planned Developments
shall install streetlights and fire hydrants of a type and according
to a plan approved by the West Lafayette Board of Public Works
and Safety.
Section 2. Developers of Residential Planned Developments
shall be responsible for all utility charges for streetlights
and fire hydrants on public publicly accessible
during development.
Section 3. The City of West Lafayette shall assume financial
responsibility for monthly utility charges for street lights and
fire hydrants on public publicly accessible
within Residential Planned Developments after the following conditions
have been met:
A. The developers have transferred ownership and control of
the homeowners' association to purchasers of individual units
within the development.
B. The street lights and fire hydrants are of a type and installed
according to a plan which was approved by the West Lafayette Board of
Public Works and Safety; and
C. The Common Council of the City of West Lafayette has appropriated
sufficient funds to pay the monthly utility charges for the street lights
and fire hydrants.
D. The Common Council of West Lafayette passes a Resolution to
accept the financial responsibility of street lights and fire hydrants of
said planned development.
This resolution shall be in full force and effect from and after
its passage and signing by the Mayor.
