RESOLUTION NO. 20-97 (Amended)
A RESOLUTION FOR THE CITY OF WEST LAFAYETTE TO ACCEPT PARTIAL OR FULL
FINANCIAL RESPONSIBILITY FOR STREET LIGHTS AND FIRE HYDRANTS IN
DESIGNATED PLANNED DEVELOPMENTS

WHEREAS, The City
of West Lafayette wishes to promote health and safety including,
but not limited to, the advantages of street lights and fire hydrants
to all its citizens on a fair and equal basis.
WHEREAS, The following
named Residential Planned Developments have met the conditions
and criteria outlined in West Lafayette City Resolution No. 19-97
(Amended) as to the ownership of the Planned Development's street
lights and fire hydrants.
WHEREAS, The following
named Residential Planned Developments declare their streets are
now and will be in the future publicly accessible.
WHEREAS, The following
named Residential Planned Developments have come to the Common
Council of West Lafayette for full and/or partial relief from
cost pertaining to ownership and maintenance of the street lights
and fire hydrants within their development.
Blackbird Farms
Camelback
Castle Ridge
Pawnee Woods
Wabash Gardens
Westport
NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL
OF THE CITY OF WEST LAFAYETTE, THAT:
SECTION 1. The City
of West Lafayette offers the following plans and conditions for
acceptance of partial or full financial responsibility of future
maintenance costs including monthly utility costs associated with
street lights and fire hydrants for all or part of the named Planned
Developments.
SECTION 2. The named
Planned Developments will select a following plan and it will
be enforced after approval of the City Engineer and the West Lafayette
Board of Public Works and Safety.
Plan 1: At this time
the Residential Planned Development will keep its current financial
responsibility for the street lights and/or fire hydrants within
its development as is.
Plan 2: The Residential
Planned Development wishes to install or use standard street lights
and/or fire hydrants normally associated with a standard (type
and quantity) subdivision lighting and fire hydrant plan as determined
by the City Engineer and acceptable to the West Lafayette Board
of Public Works and Safety. The City of West Lafayette will then
take full financial responsibility of maintenance and future monthly
utility costs. The installation cost of additional street lighting
or standardization and/or placement of additional fire hydrants
in the so named Planned Developments will be the responsibility
of the lot owners or the homeowners association within said Planned
Development.
Plan 3: The Planned
Development will invoice the City of West Lafayette in a manner
set forth by the West Lafayette Clerk-Treasurer for the monthly
utility cost for street lights and fire hydrants cost normally
associated with a standard (type and quantity) subdivision lighting
and fire hydrant plan as determined by the City Engineer. The
Planned Development will retain ownership and maintenance of the
street lights and fire hydrants within the Development.
This resolution shall be in full force and effect from and after
its passage and signing by the Mayor.
